Fnatic Plus - Trial Terms & Conditions
1. What are these terms and conditions?
1.1. The Fnatic Plus Subscription terms and conditions (“Subscription T&Cs”) and any of the terms and conditions referred to in the Subscription T&Cs shall apply to your use of Fnatic Plus. Fnatic Plus is described in further detail on our website here fna.tc/fncplus.
1.2. These are the specific terms and conditions ("Trial Terms") which are supplemental to the Subscription T&Cs and shall apply in addition to the Subscription T&Cs where you are offered (and you accept and use) a free trial, by Fnatic (or one of our partners) for Fnatic Plus (“Trial”) for a limited time period of time (a “Trial Period”).
1.3. Capitalised terms not defined in the Trial Terms will have the meanings given to them in the Subscription T&Cs.
1.4. By signing up for or using a Trial, you agree to these Trial Terms, the Subscription T&Cs and any terms and conditions referred to in them.
1.5. Trial Eligibility. Trial eligibility is determined by Fnatic in our sole discretion. We may limit eligibility to prevent free Trial abuse.
2. Activating your Trial.
2.1. Unique Code. In order to activate your Trial and access Fnatic Plus you will be required to activate a single-use unique Trial code (“Trial Code”) and accept these Trial Terms and the Subscription T&Cs through the ‘Subscribe’ button on either the Fnatic mobile application (“Fnatic App”) or the Fnatic website. You will be provided with details of your Trial, Trial Period and the automatic rollover of your Trial into a paying monthly Plus Subscription in advance of your activation of the Trial Code. Fnatic shall in its sole discretion the manner in which it provides you with your Trial Code.
2.2. Subscription sign-up. In order to activate your Trial Code, you will need to enter your Trial Code at the point of purchase/subscribing to Fnatic Plus. Upon entering your Trial Code, the price shown for your first month’s Plus Subscription to Fnatic Plus will appear at the discounted price of $0.00. This discounted Trial exclusive price only applies to your Trial and Plus Subscription during the Trial Period.
2.3. Trial Length. The Trial will begin on the date that you accept the Trial offer and enter your Trial Code in accordance with Paragraph 2.2 above, and shall, regardless of whether you use Fnatic Plus, expire at the end of the Trial Period. The length of your Trial Period will be communicated to you at the point of being provided with the Trial Code.
2.4. Valid Payment Method. You must input a valid payment method at the point of purchase/subscribing to Fnatic Plus in order to participate in a Trial. Fnatic shall be entitled (at its sole discretion) to terminate your Trial in the event that your method of payment is found to be invalid.
2.5. You acknowledge and agree that we may withdraw or modify the Trial, at any time, at our sole discretion by giving you 5 days’ notice.
3. Automatic Rolling Subscription
3.1. Upon expiry of the Trial Period your account and access to Fnatic Plus will automatically rollover into a Plus Subscription (governed by the Subscription T&Cs) at the then-current monthly Subscription Fee, with no further action necessary from you, unless you have terminated your Trial prior to the expiry of the Trial Period in accordance with these Trial Terms.
3.2. Where your Trial has rolled over into a Plus Subscription plan, we will charge you the then-current monthly Subscription Fee on the first day after the end of your Trial Period unless you have terminated your Trial prior to the expiry of the Trial Period in accordance with these Trial Terms.
3.3. You should check all of the key information that has been made available to you in respect of the Trial and Plus Subscription on the Fnatic website, in particular the Payment Terms. You must cancel your Trial, in accordance with Paragraph 6 below, in advance of the end of the Trial Period if you are not happy with the Payment Terms.
4. Your Trial benefits
4.1. During the Trial Period you will be entitled to the same benefits as you would have under a Plus Subscription, which are detailed on our Fnatic Plus webpage fna.tc/fncplus. Once you have activated your Trial in accordance with Paragraph 2 above, you will be able to access your Trial benefits straight away by logging into your Fnatic ID on the Fnatic App or website. The Subscription T&Cs shall apply to the benefits granted to you during your Trial.
5. Plus Subscription Fees
5.1. Fnatic agrees to provide you with the Trial by not charging you for the Trial Period, in accordance with Paragraph 2.2 above. On expiry of the Trial Period, all normal billing and cancellation rules that usually apply to Plus Subscriptions, as detailed in the Subscription T&Cs, will apply to your Plus Subscription and use of Fnatic Plus.
5.2. Fnatic Plus Subscriptions can either be purchased on a monthly or annual basis. As per Paragraph 3, upon expiry of the Trial Period, your account and access to Fnatic Plus will automatically roll over onto payment on a monthly basis. If you would prefer to pay on an annual basis you will need to:
5.3. During the Trial Period, terminate your Trial in accordance with Paragraph 6 below; or
5.4. After the Trial Period, terminate your Plus Subscription in accordance with the Subscription T&Cs; and re-subscribe to Fnatic Plus on an annual basis.
6. Termination of your Trial
6.1. Fnatic may terminate or modify the Trial at any time (with or without notice to you).
6.2. You can cancel your Trial (and subsequent rollover to a monthly Plus Subscription)l at any time, during the Trial Period, however, it may take up to 24 hours for your cancellation to be processed by our third-party providers. The cancellation of the Trial will be effective from the end of the subscription month.
6.3. How to cancel. To cancel your Trial you will need to: (i) where you have subscribed through the Fnatic website, login to your Fnatic ID using your email address and password, view your Trial and cancel it; (ii) where you have subscribed through the Fnatic App, cancel your Trial (which will be listed as a subscription) through your mobile phone’s subscription settings.
7. Responsibility for Loss or Damage Suffered by You
7.1. The Liability provisions set out in the Subscription T&Cs shall apply to your use of the Trial.
8. Other Important Terms (General)
8.1. Severance. If a court finds part of this contract unenforceable for any reason, the rest will continue in force. Each of the sections of these Trial Terms operate separately.
8.2. Governing Law and Jurisdiction. These Trial Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by English law. The Courts of England and Wales have exclusive jurisdiction in relation to any such dispute or claim.
