Fnatic Plus | Subscription Terms and Conditions

  1. Who we are
    1. We are Fnatic Limited (that's who we mean by "Fnatic", "we, "us" or "our").
    2. We are a limited liability company incorporated and registered in England and Wales with company number 07805670, whose registered office is at 1 Kingsland Passage, London, United Kingdom, E8 2BB.
  2. What are these terms and conditions?
    1. These are the terms and conditions ("Subscription T&Cs") on which we supply you with our online subscription service known as Fnatic Plus (“Fnatic Plus”), which we describe in further detail on our website (https://fnatic.com/fnatic-plus), and any of the related goods and services that may form a part of the Fnatic Plus subscription from time to time, including any promotions, goods or services offered by our partners ("Plus Subscription").
    2. These Subscription T&Cs, any terms and conditions that apply to your use of your Fnatic ID account (“Fnatic ID”) and any of the terms and conditions referred to in these Subscription T&Cs shall apply to your purchase and use of your Plus Subscription and are expressly incorporated in these Subscription T&Cs.
    3. By signing up for, or otherwise using, the Plus Subscription, you agree to these Subscription T&Cs and any terms and conditions referred to in them.
  3. Purchasing of a Subscription
    1. Who can purchase a Plus Subscription?
    2. Subject to the terms of these Subscription T&Cs, we accept purchases of our Plus Subscription by Fnatic fans aged 18 or over and who have legal capacity to enter into a binding contract.
    3. Age Requirements. If you are aged under 18 (or the age of being a minor in your home country) then your parent or guardian will need to enter into these Subscription T&Cs on your behalf. In order for you to use your Plus Subscription, your parent and guardian confirms that you are:
      1. 13 years of age (or the equivalent minimum age in your home country) or older; and
      2. not barred from using Fnatic Plus under any applicable laws.
    4. Fnatic ID. In order to purchase a Plus Subscription you will need to either:
      1. have an existing Fnatic ID which can be linked to your Plus Subscription; or
      2. register with us for a new Fnatic ID prior to your purchase of the Plus Subscription. You will not be able to purchase a Plus Subscription or use Fnatic Plus without a Fnatic ID.
    5. How to purchase a Plus Subscription.
    6. In order to purchase your Plus Subscription, you will be required to accept these Subscription T&Cs and confirm your purchase through the ‘Subscribe’ button on either the Fnatic mobile application (“Fnatic App”) or the Fnatic website.
    7. You should check all of the key information that has been made available to you in respect of the Plus Subscription on the Fnatic website (https://fnatic.com/fnatic-plus), in particular the information relating to the price of and rolling nature of your Plus Subscription (“Payment Terms”). You must not purchase a Plus Subscription if you are not happy with the Payment Terms.
    8. Icon Link. If you use a link provided or made available to you by one of Fnatic’s official “icons” (“Fnatic Icon”), linking to our Plus Subscription page (on our website or the Fnatic App) and purchase your Plus Subscription having followed that Fnatic Icon’s link, then that Fnatic Icon will receive a ‘thank you’ payment from Fnatic for supporting Fnatic Plus.
    9. How we will accept your Plus Subscription purchase. Your purchase constitutes an offer, by you to us, to purchase a Plus Subscription. Our acceptance of that offer (and the formation of a contract between you and us according to these Subscription T&Cs) will take place automatically upon your payment to us, at which point a legally binding contract will be formed between you and us.
    10. Once your purchase is submitted it will be processed immediately and automatically by either: (i) our payment provider Stripe, where you have purchased your Plus Subscription through our website; or (ii) your app store provider (either Google or Apple), where you have purchased your Plus Subscription through the Fnatic App.
    11. Payment method. Payment for the purchase of your Plus Subscription can be made by using: (i) a MasterCard, Visa or American Express debit or credit card, where you are purchasing your Plus Subscription through our website; or (ii) any cards supported by your app store provider (Google or Apple), subject to your app store provider terms and conditions, where you have purchased your Plus Subscription through the Fnatic App.
    12. If we cannot accept your purchase. If we are unable to accept your purchase of the Plus Subscription, you will be  informed of this in the manner determined by the method in which you are attempting to purchase your Plus Subscription (e.g by STRIPE, if using our website or by Google or Apple, if using the Fnatic App) and we will not charge you.This might be because:
      1. Plus Subscriptions are no longer available or the features of Fnatic Plus have been incorporated into a new or existing Fnatic product or service;
      2. of unexpected limits on our resources, our third party providers resources or the app store provider’s resources, which we could not reasonably plan for;
      3. we have identified an error in the price or description of the Plus Subscription; or
      4. we are unable to provide you with your Plus Subscription due to local laws or regulations.
    13. If we incorrectly state a price online or otherwise, we are not obliged to provide you with a Plus Subscription at that price, even if we have mistakenly accepted your offer to buy a Plus Subscription.  If we notify you of a pricing error, you may cancel the Plus Subscription and we will refund you any money paid, or you may pay the correct price. If you do neither, we may cancel your Plus Subscription and refund any money you have paid. We will always act in good faith in determining whether a genuine pricing error has occurred.
  4. Your Plus Subscription
    1. Your benefits. By purchasing the Plus Subscription and paying any recurring subscription fees to keep your Plus Subscription active, you will be provided with the Fnatic Plus benefits as set out on our Fnatic Plus Webpage (https://fnatic.com/fnatic-plus). 1. Partner terms and conditions. Fnatic may partner with third parties, in order to provide to you some of the benefits of your Plus Subscription. Where Fnatic has partnered with these third parties, those third parties' own terms and conditions may apply to the services being provided (e.g. delivery terms and conditions where that relevant partner is providing a product as part of a Subscriber Competition). Where this is the case Fnatic will use reasonable endeavours to bring those third party partners terms and conditions to your attention.
  2. Occasionally, certain Fnatic Plus benefits will only be made available to Fnatic Plus subscribers in certain locations. For example, Subscriber Competitions that we run in conjunction with our partners which involve a physical prize may only be made available to Fnatic Plus subscribers that live in countries that our partners are able to ship their products to.
  3. We reserve the right to amend the scope of your Plus Subscription from time to time. We will give you at least 30 days’ notice of any significant reduction in the scope of your Plus Subscription, and these will only take effect from the date following that 30-day period. This does not apply where a benefit, type of content or service is made available to Fnatic Plus subscribers on an introductory, temporary or trial basis.
  4. Private Use. We only supply Plus Subscriptions for private and non-commercial use. We reserve the right at any time and in our sole discretion to verify your eligibility and compliance with these Subscription T&Cs, including but not limited to, ensuring that the Plus Subscription is not being used for a commercial purpose.
  5. Plus Subscriptions cannot be exchanged for other goods or products and are only eligible for refunds to the extent expressly set out in these Subscription T&Cs.
  6. Plus Subscription Fees
    1. Subscription Fee. Subject to either you or us exercising our rights to cancel or terminate the Plus Subscription, you authorise us to, and accept that we will, charge your original payment method on a recurring basis until you cancel or we terminate your access to the Plus Subscription (“Subscription Fee”). The first payment of the Subscription Fee will be taken the day you sign up for the Plus Subscription.
    2. Payment Date - Monthly Subscription

The recurring Subscription Fee will be charged on the same day each month or where you start your Plus Subscription on the last day of a month, your Subscription Fee will be taken on the last day of the following month.  For example, if you subscribed on 6 September, your next payment would be on 6 October. If you subscribed on the last day of the month, and your billing date is not present in that month (say, the 31st), then the preceding date is selected. Then the renewal shifts back to the original date in the next month. For example if you subscribed on 31 March, your next payment will be on the last day of the following month, 30th April, and subsequently on 31 May, 30 June, etc.

  1. Payment Date - Annual Subscription

The recurring Subscription Fee will be charged on the same date each year. For example, if you subscribed on 6 September, your recurring payment will be take on the same date in the following year.

  1. Your Plus Subscription provides you the right to use the Fnatic Plus benefits at your discretion (subject to these Subscription Terms). Your non-use will not obligate us to provide you with any refund, in whole or part, of your subscription fee. You remain responsible for any uncollected amount.
  2. Payment failure. If a payment is not successfully made, due to payment method expiration, insufficient funds, the chargeback of a previously valid payment, or otherwise (“Payment Failure”) and you do not cancel your Plus Subscription, then your Plus Subscription will enter into a grace period of 7 days (“Grace Period”). During the Grace Period, you will still be able to access your Plus Subscription and we (via the relevant third party: STRIPE, Google or Apple) shall automatically re-attempt to take the recurring Subscription fee from your account. If there is a Payment Failure after the Grace Period, then what happens depends on how you have paid for your Plus Subscription. Where you have purchased your Plus Subscription:
    1. through the Fnatic App and you are using Apple as your app store provider then any Payment Failure (after the Grace Period) will put you into a further billing retry group which lasts a further 60 days. You will not be able to access Fnatic Plus during this additional 60 day period;
    2. through the Fnatic App and you are using Google as your app store provider then any Payment Failure (after the Grace Period) will place your Fnatic Plus account on an “account hold”. You will not be able to access Fnatic Plus once your account has been put on “account hold” by Google; or
    3. through the Fnatic website then any Payment Failure (after the Grace Period) will place your Fnatic Plus account on an “account hold”. You will not be able to access Fnatic Plus once your account has been put on “account hold” by our third party payment provider.
  3. Updating details. You may add, update or change payment cards or other subscription details such as email address and billing address using your Fnatic ID profile within the Fnatic App or your Fnatic ID login on the Fnatic website.
  4. Currency The default supported currencies on our websites for the purchase of a Plus Subscription will be: (i) Great British Pounds; (ii) Euros; (iii) US Dollars; (iv) Japanese Yen (“Supported Currency”). Our website will automatically default to using the Supported Currency that is most relevant to your IP address, and display the price of your Plus Subscription in that Supported Currency.  You are able to change the Supported Currency used to purchase your Plus Subscription on our website. You can purchase Fnatic Plus using a currency that is not a Supported Currency; the cost of your Plus Subscription will be converted from the Supported Currency into the currency you are using to purchase your Plus Subscription in accordance with our third party payment provider’s exchange rates (and terms and conditions) at the time of your purchase.
  5. If you are purchasing your Plus Subscription through the Fnatic App, you will be able to do so using any currency that is supported by the relevant app store provider (Google or Apple). Please see your app store provider’s terms and conditions for further information. Please note that we provide the app store providers with a base rate for a Plus Subscription, which is then converted into your local currency. Fnatic does not have any control over that conversion or the relevant exchange rates used by your app store provider.
  6. Changes to subscription fees. If the amount to be charged for a recurring subscription fee changes from the current fee, we shall provide notice of the amount to be charged and the date of the charge at least thirty (30) days before the scheduled date of payment of the recurring subscription fee. If, as a result of the fee change, you want to cancel your subscription, please follow the steps in Section 7 below.
  7. Fnatic Memberships
    1. Fnatic Memberships. If you were previously a ‘Core’ or ‘Pioneer’ member of Fnatic’s membership program  (“Fnatic Member’) then you will automatically be granted access to Fnatic Plus, provided that your Fnatic ID is still connected to and has attached your Fnatic Member unique key (provided to you previously as a Fnatic Member). The length and cost of any Gift Subscriptions, when they are offered, will be brought to your attention prior to your purchase or receipt of a Gift Subscription.  Gift Subscriptions are subject to these Subscription T&Cs. By activating a Gift Subscription, the recipient agrees to these Subscription T&Cs.
    2. No automatic renewal. Gift Subscriptions will not renew automatically, and the Gift Subscription recipient will be informed of its expiry date in advance. Once a Gift Subscription has expired, the recipient will no longer have an active Plus Subscription (or acc unless they sign up for a new Plus Subscription.
    3. Cooling off Period. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have the right to cancel a Gift Subscription, for any reason, within 14 days of the date of your Plus Subscription starting without having to give a reason, by contacting us in writing on the details provided in these Subscription T&Cs (provided the Gift Subscription has not been activated). Gift Subscriptions become void once cancelled. Refunds of the original price paid will only be made where a request has been made by the Gift Subscription purchaser and will be made to the Gift Subscription purchaser only, onto the original payment card. No refund or credit note will be given to the Gift Subscription recipient.
    4. Method of delivery. Gift Subscription recipients will receive a unique code (“Gift Code”) that should be kept safe, as lost or stolen Gift Subscriptions cannot be replaced. Fnatic is not responsible for unauthorised use of Gift Codes or Gift Subscriptions. Gift Codes are valid for use until the expiry date stated on the email or other correspondence sent to the Gift Subscription and Gift Code recipient. Where the Gift Subscription recipient is an existing Plus Subscriber, the Gift Subscription will start from their next renewal date.
    5. Once a Gift Subscription has been activated, this means the Gift Subscription recipient has consented to the immediate start of their Plus Subscription (or where the Gift Subscription recipient is an existing subscriber of Fnatic Plus, the Gift Subscription will start from the next renewal date) and the Gift Subscription purchaser loses their right of cancellation and refund.
  9. Cancelling your Plus Subscription
    1. You can cancel your Plus Subscription at any time, however it may take up to 24 hours for your cancellation to be processed by our third party providers. You will not receive a refund for any part of a month or year in which you cancel. For example, if you start a monthly Plus Subscription on 7 July, cancel it on the 19 July, you can continue to use it until 6 August, at which point it will expire.
    4. Cooling-Off Period. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your Plus Subscription, for any reason, within 14 days of the date of your subscription starting (the Cooling-Off Period). Please note that this right to cancel will not apply to any monthly renewals of your Plus Subscription.  If you wish to exercise your right to cancel within the Cooling-Off Period you must contact us to let us know that you are doing so. You may do this by contacting Customer Services in writing using the contact details set out in Section 11. We will send you an acknowledgement of receipt of that notice by email.
    5. If you exercise your right of cancellation in accordance with Section 7.4, your Plus Subscription will come to an end (and access to Fnatic Plus will be terminated) and we will reimburse you any payments received from you for your Plus Subscription. We will make this reimbursement no later than 14 days after the day on which we are informed about your decision to cancel your Subscription. We will make the reimbursement using the same means of payment you use to pay for your Subscription, unless you expressly agree otherwise.
    6. You expressly acknowledge and agree that:
      1. we may give you access to your Plus Subscription during the Cooling-Off Period; and
      2. if you exercise the right to cancel set out in Section 7.4:
        1. prior to actively using your Plus Subscription, you will receive a full refund (which may be £0 if it was a Gift Subscription);

    2. We shall be entitled to withdraw the Plus Subscription program and Fnatic Plus as a service at any time. We may at our election also incorporate the features of Fnatic Plus into a new or existing Fnatic product or service.  We will write to you to let you know that we are going to stop providing the Plus Subscription and Fnatic Plus at least 30 days in advance of our stopping the Plus Subscription and Fnatic Plus and will not take any subsequent recurring subscription fees.
    3. We will also be entitled to terminate your Plus Subscription if:
      1. you are in serious breach of these Subscription T&Cs;
      2. you are in serious breach of any other terms and conditions or agreements with us, or any of our policies (including those referenced and/or incorporated in these Subscription T&Cs), and we reasonably believe that such breach may prejudice the performance of your obligations under these Subscription T&Cs;
      3. you breach these Subscription T&Cs, or any other terms and conditions, in a way which is not serious but is: (i) repeated; or (ii) not put right within 30 days of us notifying you of the breach;

    3. We are not liable for business losses. We only supply the Plus Subscription to you for personal use. If you use the Plus Subscription for any commercial, business or resale purpose (in breach of these Subscription T&Cs) we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
    4. Our responsibility to you. If we fail to comply with these Subscription T&Cs, we are, subject to the rest of this Section 9, responsible for loss or damage you suffer that is a foreseeable result of our breach of these subscription T&Cs or our negligence, but we are not responsible for any loss or damage that is not foreseeable. 13. Other Important Terms (General)
    1. Right of refusal. We reserve the right to refuse to accept a new Plus Subscription purchase or any monthly or annual renewal if we reasonably believe that you are not complying (or have not in the past complied) with these Subscription T&Cs.
    2. Mandatory changes to these terms. In such circumstances, we shall be entitled to a reasonable extension of the time for performing such obligations and may:
      1. suspend your Plus Subscription for the period during which your subscription cannot be used. During such a suspension period, we will take no further payments from you under these Subscription T&Cs.
