Fnatic Crew Terms and Conditions

Fnatic Limited (Fnatic, we, us, our) offers our content creators (Creator(s)) the opportunity to be part of our creator network (Fnatic Crew) and earn payments and/or bonuses by creating content and completing deliverables for Fnatic and/or Fnatic partners.

These terms (the Terms) explain your rights and responsibilities as a Creator when you join the Fnatic Crew. The Terms are so important that you can’t join the Fnatic Crew unless you agree to them.

By joining the Fnatic Crew, you are agreeing to be bound by the Terms and agree to abide by Fnatic's Terms and Policies, including Fnatic’s Website Policy, Privacy Policy, Social and Community Policy, and Safeguarding Policy.

1. Participation in the Fnatic Crew

1.1 Applicants must be 18 years or older and based in the United Kingdom during the initial launch phase of Fnatic Crew. The first intake will focus on the United Kingdom, with recruitment opening in November 2025, and expansion to new regions planned for 2026.

1.2 If you are offered the opportunity to join the Fnatic Crew, you are able to create content on your social media channels, including streaming platforms (together, the Channels) using the Fnatic Materials (see Section 5 below for more on Fnatic Materials).

1.3 Your participation in the Fnatic Crew is at our sole discretion and always subject to the Always-On Obligations (see below). We reserve the right to remove you from the Fnatic Crew, for any reason and at any time by giving you notice by email.

1.4 Please let us know if you no longer want to be part of the Fnatic Crew.

1.5 To remain eligible for the Fnatic Crew, Creators must maintain consistent Fnatic and partner visibility across their Channels. This includes, but is not limited to:

  • Twitch Panels displaying approved Fnatic and/or partner branding;
  • Chatbot commands linking to affiliate URLs or Drop pages;
  • Profile bios, overlays, or banners featuring Fnatic and partner identifiers;
  • Attendance to workshops / Fnatic Crew events / Fnatic & Red Bull events; and
  • Fnatic Creator added to the Channels’ bios

(together, the Always-On Obligations).

1.6 These Always-On Obligations are a requirement for ongoing eligibility within the Fnatic Crew programme and for participation in future Drops or payment pools.

1.7 While part of the Fnatic Crew, Creators agree to be exclusive to:

  • Fnatic; and
  • Red Bull.

Creators must not represent, promote, or collaborate with esports organisations or gaming teams that compete with Fnatic or brands that directly compete with Red Bull (e.g. other energy drinks) without obtaining Fnatic’s prior written consent.

1.8 Breach of exclusivity (including Drop Exclusivity, defined below) and/or the Always-On Obligations, in part or in whole, may result in immediate removal from the Fnatic Crew and forfeiture of pending Drops or payments.

2. Qualifying Content and Payment

Drops

2.1 As a Creator, you have the opportunity to opt into paid campaign activations for Fnatic, Red Bull, and/or other official Fnatic partners (each a Drop).

2.2 Each Drop represents a standalone paid opportunity with details around required content deliverables, applicable payment terms and/or other commercial terms included in a brief (each a Drop Brief) which you may be eligible to opt into via a dedicated Fnatic Crew page or platform, either on Discord or elsewhere as we communicate to you.

2.3 We reserve the right to either accept or refuse your participation in any Drop at our sole discretion. Acceptance of your participation in a Drop shall be communicated to you directly. If no acceptance has been communicated, that shall be deemed a refusal.

2.4 You may be required to grant limited exclusivity to Fnatic partners as part of a specific Drop (Drop Exclusivity). Drop Exclusivity will be in addition to the exclusivity granted at Section 1.7 above. You will be made aware and provided with all relevant details of any Drop Exclusivity in the relevant Drop Brief. If You wish to participate in a Drop, but the Drop Exclusivity prevents You from participating or gives rise to a potential conflict of interests, then You can either withdraw from participating in the Drop or contact us at streaming@fnatic.com or via the Fnatic Crew Discord channel, whereby we may (at our sole discretion and in line with our partners requirements) be able to make reasonable accommodations on a case-by-case basis.

Creator Commission & Bonuses

2.5 As a Creator, you are eligible to receive payments for completed Drops (Creator Commission) where such Drops comply with all material respects with the requirement of these Terms and the applicable Drop Brief, subject to our final approval (each being Qualifying Content).

2.6 As a Creator you may become eligible to receive bonuses for posting Qualifying Content on your Channels, provided the Qualifying Content meets certain content targets (a Creator Bonus). Creator Bonus opportunities and their relevant payment terms will be communicated to you separately.

2.7 Either Fnatic or an official Fnatic partner may decide to offer Creator Bonuses. We reserve the right, at our sole discretion, to introduce, adjust or remove any Creator Bonuses by giving you seven (7) days’ written notice.

2.8 Neither Fnatic nor any official Fnatic partner is obligated to offer any Drops or Creator Bonuses.

2.9 Subject to Section 2.10, Fnatic shall pay, or shall procure that an official Fnatic partner pays, any Creator Commission as detailed in the applicable Drop Brief, and any applicable Creator Bonus.

2.10 You are solely responsible for any taxes (including VAT or your national equivalent) that may be due in connection with your participation in the Fnatic Crew. You will account to any relevant taxation authority for any income tax and any other statutory liability, deduction, contribution, assessment or claim arising from or made in connection with your participation in the Fnatic Crew.

Tracking

2.11 Fnatic uses a third party software provider (Tracking Partner) to automatically track and verify Qualifying Content.

2.12 Fnatic shall not be responsible for the acts or omissions of the Tracking Partner.

2.13 Fnatic shall, on our own or through the Tracking Partner or other third party providers, be entitled to monitor your Channels. We shall not be required to pay you any Creator Commission or Creator Bonus (in whole or in part) where:

(a) you are in breach of these Terms;

(b) in our reasonable opinion, we have a legitimate reason for doing so; or

(c) where we are legally obligated to do so, including in circumstances where there are signs of suspected fraud.

3. Creator Obligations and Standards

3.1 You must ensure that, as a member of the Fnatic Crew, you and your content adhere to certain standards. When using the Fnatic Materials you must ensure that:

(a) you are complying with your Always-On Obligations;

(b) you are using the required up to date Fnatic Materials, as provided by Fnatic, in accordance with Fnatic’s brand guidelines;

(c) the content posted on your Channels is accurate and appropriate;

(d) the content posted on your Channels is not libellous or unlawful, and does not violate or infringe upon the rights of any third party (including, but not limited to, copyrights, trademarks, privacy or other personal or proprietary rights);

(e) your Channels and content complies with all applicable local laws and regulations, including any codes of practice applicable to your marketing and displaying content on your Channels, and that you have in place appropriate legal notices (see Section 6 for an example only); and

(f) you do not use, make available or promote the Fnatic Materials on or in connection with any content, platforms or sites or with any individuals that may, in Fnatic’s reasonable opinion, result in our goodwill or reputation, or the goodwill and reputation of any of our partners, being damaged.

3.2 Fnatic expects all creators which it engages to apply and maintain high standards of personal conduct. Whilst part of the Fnatic Crew, you must:

(a) comply in a professional manner with these Network Terms;

(b) immediately raise to Fnatic any concerns or confusion that you may be experiencing which may affect your obligations under these Network Terms, and thereafter comply with any reasonable direction issued by Fnatic;

(c) not:

(i) break any rules applied by the platform on which you stream or create content (i.e. Twitch, YouTube, Instagram, etc.) or the developer of any game you play;

(ii) issue or promote (by way of post or repost) via your Channels any content which is, or which Fnatic considers to be: (x) illegal, defamatory, racist, sexist, discriminatory or obscene; (y) damaging or potentially damaging to Fnatic's reputation; (z) critical of Fnatic or any of Fnatic’s partners;

(iii) use tools (such as, but not limited to: bots, fake redirects, iframes, hidden frames or automated software) to increase your subscriber/ follower count, viewership or artificially influence anything we use to assess your performance; or

(iv) do anything which breaks the law in any place where you post on your Channels.

3.3 If you violate any of the standards set out in this Section 3, Fnatic has the right to suspend or remove you from the Fnatic Crew and withhold and/or cease all payments to you, including any payments that have accrued and have not yet been paid to you.

4. Responsibility for your Channels

4.1 You are solely responsible for your Channels, including their development, operation and maintenance and all content and materials that appear on or within them, except for Fnatic Materials). Fnatic is not liable for any content, materials or information on your Channels or for any of your users’ claims relating to your Channels (except where it relates to Fnatic Materials), and you agree to defend, indemnify, and hold Fnatic harmless from and against all claims which relate to your Channels and their content (except as set out above).

5. Intellectual Property

5.1 Fnatic Materials means any banners, logos, graphics packs, headers, stream overlays or other creative assets provided to you, including Fnatic partner materials and marks (Partner Marks), including all intellectual property owned by Fnatic or a member of Fnatic’s group (Fnatic Marks).

5.2 Title to and ownership of all Fnatic Materials, including all intellectual property rights in the Fnatic Materials and all goodwill associated with them, are and will remain the exclusive property of Fnatic or a Fnatic partner or licensors, as the case may be. Nothing in these Network Terms grants or transfers to you any right, title or interest in or to the Fnatic Materials. At no time during or after your participation in the Fnatic Crew will you challenge (or assist or procure others to challenge) the Fnatic Marks or the Partner Marks, or the registration thereof, or attempt to register any trademarks, service marks, trade names or domain names confusingly similar to the Fnatic Marks or Partner Marks.

5.3 Subject always to Section 5.5 below, Fnatic hereby grants you a non-exclusive, royalty-free, fully paid-up non-transferable, non-sublicensable, non-assignable, revocable, limited licence to use the Fnatic Materials solely for the purposes expressly contemplated by these Network Terms and in accordance with our strict instructions. Your right to use the Fnatic Materials ends as soon as your participation in the Fnatic Crew ends for any reason. If you wish to use the Fnatic Materials for any other purposes you must first obtain our prior written approval.

5.4 All goodwill resulting from your use of the Fnatic Materials is solely for the benefit of Fnatic and/or the Fnatic partner, as the case may be.

5.5 In connection with the Fnatic Crew, you agree that you will not infringe on any third party’s intellectual property rights. If Fnatic is notified, or has reason to believe that your content has allegedly infringed upon a third party’s intellectual property rights, we shall be entitled to, at our sole discretion: (i) suspend your participation in the Fnatic Crew until the alleged infringement has been investigated; (ii) require you to remove the infringing content; and/or (iii) where you have been found to infringe a third party’s intellectual property rights, remove you from the Fnatic Crew.

5.6 We automatically have rights in any Qualifying Content you generate or make available which​ incorporate the Fnatic Materials (in whole or in part). You hereby grant us (or any ​other company we choose) a non-exclusive, fully-paid, royalty-free, irrevocable, perpetual, transferable, and sublicensable license to use, copy, modify, adapt, distribute, prepare derivative works based on, publicly perform, publicly display, make, have made, use, sell, offer to sell, import, and otherwise exploit Qualifying Content for any purposes, for all current and future methods and forms of exploitation in any country. We may require that you remove any Qualifying Content of which we don’t approve (in our sole discretion). If you don’t comply with a request to remove / take down Qualifying Content, then we can remove you from the Fnatic Crew.

6. Identification as a Creator

6.1 You must ensure that on any and all Channels which you communicate or promote Fnatic and/or official Fnatic partners, you must clearly and conspicuously disclose your relationship and the fact that you receive payment or other compensation. In order to do this, you should:

(a) use the identifier “ad” or “advert” in the bio of each video or stream that includes such a promotion (or any local language equivalent);

(b) not make any false, misleading or deceptive statements about Fnatic, Fnatic’s official partners or the Fnatic Crew;

(c) ensure that any opinion or personal endorsement given about Fnatic and/or Fnatic’s official partners is honestly and genuinely held; and

(d) not make unsupported or untruthful product performance or attribute claims concerning Fnatic and/or Fnatic’s official partners without personal knowledge or substantiation (i.e. proof) of the same.

7. Confidentiality

7.1 For the purposes of this Section 7, Confidential Information means any proprietary or confidential information or materials (including the terms of your participation in Fnatic Crew, any business, technical, statistical, financial, marketing and personnel information, customer or supplier details, know-how, trade secrets, materials, software, official communications, contracts, sponsorships, player rosters) whether in oral, written, graphic, electronic or other form, that are (i) marked or described as, or otherwise designated as, proprietary or confidential, or (ii) provided under circumstances reasonably indicating that the information or materials are proprietary or confidential, or which a reasonable business person would understand to be confidential.

7.2 You shall maintain the confidentiality of all Confidential Information disclosed by Fnatic or Fnatic’s partners for the duration of your participation in Fnatic Crew, and for a period of two (2) years after your exit from Fnatic Crew, unless otherwise required by law, a court of competent jurisdiction or any governmental or regulatory authority.

7.3 The provisions of this Section 7 shall not apply to Confidential Information that (a) is or becomes publicly available through no fault of yours; (b) is already in your lawful possession before you join Fnatic Crew, other than pursuant to disclosure from Fnatic or Fnatic’s partners; or (c) is independently developed without reliance on Fnatic or a Fnatic partner’s Confidential Information.

7.4 You shall not use Confidential Information for any purpose other than to exercise your rights and perform your obligations under or in connection with Fnatic Crew.

8. Liability

8.1 Indemnification. You agree to indemnify, defend, and hold harmless Fnatic, its affiliates and subsidiaries, and each of their respective directors, members, officers, employees, contractors, representatives, agents, successors and assigns from and against any and all damages, judgements, settlements, awards, penalties, and costs (including reasonable lawyers’ fees) in relation to a third party claim arising from or related to: (i) your violation of applicable laws or regulations or applicable codes of practice; (ii) any infringement by you of any third party intellectual property.

8.2 Limitation of Liability. Nothing in these Terms, including this Section 8.2, shall attempt to exclude or limit liability that can't be excluded or limited under applicable law including death or personal injury caused by a party’s negligence, or for fraudulent conduct. Subject to this, and to the maximum extent permitted under applicable law, Fnatic will not be liable for any loss of profits, loss of sale or business, loss of agreements or contracts, loss of use or corruption of software, data or information, loss of or damage to goodwill, or any indirect, special or consequential damages of any kind arising in connection with these Terms or the Fnatic Crew. Further, subject to the preceding parts of this Section 8.2, Fnatic’s aggregate liability arising with respect to these Terms, and your participation in the Fnatic Crew, will not exceed the total Creator Commission and Creator Bonuses paid to you in the previous six (6) months preceding any claim. All claims made by you against Fnatic in relation to these Terms shall be made within one hundred and twenty (120) days of the relevant act or omission which forms the basis of such claims.

9. Warranties

9.1 Fnatic makes no express or implied representations or warranties to you, including as to any compensation that you may earn through Drops.

9.2 By joining the Fnatic Crew, you warrant that:

(a) you are at least 18 years old on the date on which you agreed to comply with the Terms, or your parent or legal guardian has read and approved the Terms and authorised you to participate in the Fnatic Crew;

(b) whilst you are part of the Fnatic Crew, you:

(i) have the right to live and work in the country of your residence;

(ii) are not bound by any agreement with a third party that adversely affects your participation in the Fnatic Crew;

(iii) are not represented by any agent / agency, manager or any other form of intermediary (or, if you are so represented, that any compensation payable to such intermediary will be paid by you from the Creator Commission and Creator Bonus(es) and Fnatic shall have no liability to such intermediary of any kind at any time in perpetuity).

10. Right to Audit

10.1 Fnatic has the right to audit you, your Channels, or activities related to your Channels, including compliance with these Terms and your participation in the Fnatic Crew. If we believe that you have breached these Terms, we may take any steps we deem appropriate (in our sole discretion), such as: (i) issuing a warning; (ii) conducting an investigation; (iii) removing you from the Fnatic Crew, either temporarily or permanently; and/ or (iv) withholding Creator Commission and/or Creator Bonus(es).

11. Creator Status

11.1 Your participation in the Fnatic Crew does not create any partnership, joint venture, employment or agency between you and Fnatic. That means that you can’t bind us to do or not to anything which isn’t stated in the Terms, and you must not hold yourself out as a Fnatic employee, or state (expressly or by inference) that you are expressing any official opinions on behalf of Fnatic.

12. Changes to the Terms

12.1 Fnatic reserves the right to change or modify the terms of these Terms, at any time, including but not limited to replacing these terms in their entirety. Any changes or modifications will be effective upon notification to you by the email address provided by you on registration. By continuing to participate in the Fnatic Crew after such time, you will be deemed to have accepted such change.

13. Governing Law and Jurisdiction

13.1 These Terms are governed by the laws of England and Wales. Any action relating to these Terms or your participation in the Fnatic Crew must be brought only in the courts of England and you irrevocably consent to the jurisdiction of such courts.

14. Contact and Communications

14.1 Fnatic may contact you directly with essential updates on the Fnatic Crew or in relation to use of the Fnatic Materials to the email address we have on record for you, or via Discord.
